2. Information We Collect

Softnyx combines collected Information to operate, personalize, and improve its Assets, as well as for marketing, promotions, gameplay features, and personalized communications regarding relevant updates.

Information Provided Directly by the User

You are not required to provide your real name. However, failure to provide certain required Information may limit account creation or service usage.

Mandatory Consents:

2-2. Email Verification

Email verification is mandatory. During registration, users must activate their account through a link sent to their email address.

Supported domains:

Gmail, Apple, and other widely used email domains.

Restrictions:

Domains used by only 1–10 users (approximately 15,000 domains) are not supported.

4. Protection of Minors

5-1. Access and Data Retention

Users may review, correct, update, or request the deletion of their personal data at any time by logging into their Softnyx account.

Account access requires entering a password.

[Withdrawal of Consent and Exercise of Rights]

Users may withdraw their consent at any time and exercise their ARCO rights (Access, Rectification, Cancellation, and Opposition) as recognized under applicable data protection laws.

5-2. Data Retention Period and Data Deletion

Softnyx will delete personal data when any of the following conditions apply:

  • The user terminates the contract.
  • The account is deactivated.
  • The user withdraws consent.
  • The user explicitly requests data deletion through the “Customer Inquiry” section.

However, data may be temporarily retained in the following cases:

  • Resolution of disputes and compliance with legal obligations.
  • Enforcement of the Terms of Service or other agreements with the user.
  • Existence of legitimate interests (e.g., fraud prevention, record-keeping).
  • Processing requests to unlink or disconnect linked SNS accounts.

Data Deletion Upon User Request

Softnyx deletes information in accordance with the following criteria.

Data deleted immediately:

  • Information linked to connected accounts (Facebook, Google, Apple)
  • Email data
  • Login records
  • User profile and settings
  • In-game activity data (in accordance with applicable policies)
  • Customer support inquiry history and attached files

5-3. Deletion of Facebook (Meta) Data

In accordance with Meta platform policies, when a user requests the deletion of Softnyx-related data through their Facebook account settings, the deletion of Meta-linked data is processed through Softnyx customer support systems.

Users who access services via a Facebook-linked account may request deletion of linked data through Softnyx’s “My Page.”

5-4. Deletion of Apple Data

In accordance with Apple platform policies, when a user requests the deletion of Softnyx-related data through their Apple account settings, the deletion of Apple-linked data is processed through Softnyx customer support systems.

Users who access services via an Apple-linked account may request deletion of linked data through Softnyx’s “My Page.”

5-5. Deletion of Google Data

In accordance with Google platform policies, when a user requests the deletion of Softnyx-related data through their Google account settings, the deletion of Google-linked data is processed through Softnyx customer support systems.

Users who access services via a Google-linked account may request deletion of linked data through Softnyx’s “My Page.”

5-6. Account Reuse After Data Deletion

The same rules apply to Facebook, Google, and Apple accounts:

  • After data deletion, users may sign in again using the same social account.
  • There is no waiting period (“cooldown”) required to re-register.

Deleted information will not be used for any other purpose and will not be retained beyond the period strictly necessary.

For technical reasons, residual copies stored in backup systems may remain for up to one month before being permanently deleted.

5-7. Account Withdrawal Policy

Method of Withdrawal Request

Users may request account withdrawal through one of the following methods:

  • Submitting a withdrawal request via customer inquiry.
  • Sending a withdrawal request email to the designated email address.
  • Users may be required to provide information necessary to identify the account.

Identity Verification

Upon receipt of a withdrawal request, Softnyx conducts identity verification procedures to protect accounts and personal data. If identity verification is not completed, withdrawal processing may be restricted.

Withdrawal Processing

Once identity verification is completed, the account withdrawal will be processed. Upon withdrawal, access to the service is immediately restricted and the account cannot be restored. After withdrawal, related data is processed in accordance with applicable laws and internal policies.

Important Notes

  • Withdrawn accounts cannot be reused or recovered.
  • Even after withdrawal, certain information may be retained for a limited period as required by applicable laws.

6. Data Sharing

6-1. Companies Within the Softnyx Group

Purpose: Service improvement, provision of personalized content, and internal operational support.

Information shared: Email address, ID, nickname, game data, and other necessary data.

Conditions: Group companies must comply with LGPD Art. 7, PDPA Art. 11, and GDPR Art. 6 through data processing agreements.

Softnyx is not responsible for any independent data processing carried out by these companies.

6-2. Service Providers and Partners

Recipients include: Platform providers (e.g., server hosting services), payment processors, customer support service providers, and analytics tools (e.g., Google Analytics).

Purpose of Data Sharing: To provide services, support operational activities, and improve service performance.

Types of Data Shared: Email address, payment transaction records, and anonymized statistical data.

Conditions for Data Sharing: All service providers are required to comply with applicable data protection regulations, including LGPD (Article 9), PDPA (Article 11), and GDPR (Article 28), through data processing agreements. Service providers are prohibited from using shared data for marketing purposes without the user’s explicit consent.

6-3. Legal Requirements

Recipients: Judicial, administrative, or tax authorities (including compliance with Peruvian Law No. 29733).

Purpose: Compliance with legal obligations and investigations related to fraud or unlawful activities (e.g., intellectual property infringement, misconduct).

Information shared: Account data, game data, communication records.

Conditions: Disclosure is made only in response to valid official orders.

6-4. Protection of Legal Rights

Recipients: Legal advisors, consultants, and law enforcement authorities.

Purpose: To exercise or defend Softnyx’s legal rights in cases of contractual breaches or fraudulent conduct.

Information shared: Account data, game data, and communications related to violations.

Principle: Only the minimum necessary data is shared, in accordance with LGPD Art. 6 and GDPR Art. 5.

6-5. Protection of Third Parties

Recipients: Competent authorities and relevant third parties.

Purpose: To protect the rights, property, or safety of users or other individuals (e.g., prevention of inappropriate conduct involving minors).

Information shared: Relevant account data and communications.

6-6. Sale or Transfer of Business or Assets

Recipients: Successors or acquirers in the event of a merger, acquisition, reorganization, or bankruptcy.

Purpose: To ensure continuity of service.

Information shared: Account data and game data.

Conditions: Users will be notified in advance in accordance with LGPD Art. 7, PDPA Art. 11, and GDPR Art. 6.

[Public Forums]

Information shared on public boards, chats, or forums (e.g., nicknames or posts) may be visible to other users.

Users are advised not to post personal data such as email addresses or phone numbers.

[Prohibition of Data Sharing for Marketing]

Softnyx does not share personal data with third parties for marketing purposes without the user’s explicit consent, in accordance with LGPD Art. 8, PDPA Art. 5, and GDPR Art. 7.

[International Data Transfers]

Data is primarily stored on servers located in Peru and may be transferred to servers in the United States or Korea as necessary.

Safeguards include:

  • Standard Contractual Clauses (SCCs)
  • Data encryption, in accordance with LGPD Art. 33, PDPA Art. 12, and GDPR Art. 46

Users will be clearly informed whenever an international data transfer occurs.

Softnyx implements various technical and administrative measures to protect users’ personal data.

These measures are designed to prevent unauthorized access, use, modification, or disclosure of information.

Softnyx’s security framework includes, but is not limited to:

  • Preservation of the confidentiality of collected data
  • Restriction of unauthorized access
  • Security protocols for data storage and processing

Information generated by users and publicly displayed (such as rankings, scores, or similar content) is not considered confidential by its nature.

Softnyx requires its service providers and partners who process data on its behalf to comply with the same security standards and data protection obligations, in order to prevent misuse or unauthorized alteration of personal data.

Despite these measures, the Internet environment cannot guarantee absolute security, and security risks continue to evolve.

Accordingly, Softnyx and its providers cannot guarantee complete security during the collection, storage, and processing of data.

Users are advised to exercise caution when sharing personal information in online environments.


8. Data Retention Period

  • Personal data will be deleted within 30 days after account deletion.
  • Backup copies may be retained for up to 90 days before being permanently deleted.
  • Information required to comply with legal obligations (such as tax or accounting records) will be retained for up to five (5) years, in accordance with LGPD Article 15.
